Is it alright to use a dead celebrity’s photo for an art project?
I’m supposed to choose a picture I like to draw and shade for an art project at school. I want to use a picture of Herbert Khaury, one of my favorite music artists. I intend to enter this drawing into an art competition. Is it okay to use his photo, considering that he’s deceased?
His being deceased means nothing. There is a whole new (just within the last less than twenty years) industry of legal entities which represent the estates of dead celebrities, and which license their images and other related items for a fee. The guy who started the first such law firm even got several laws passed which subsequently empowered him (and now others like him) to operate such businesses.
So, then, NEVER assume that because a celebrity is dead, his/her image or other similar things related to him/her is fair game. It is most likely not.
You have, then, been misguided by others who have posted here.
You should always presume that the estate of the dead celebrity continues to own the rights to his/her image and other similar things; and then you must find whomever represents said estate and negotiate the use of the image.
